Scott and David, Utterly fascinating interview. I loved the Pilon’s description of his “third way” as “between or, perhaps better, ‘above’ Brennan ‘activism’ and Borkian ‘restraint.” In my view, Pilon and his followers too lightly dismiss Borkian restraint. Moreover, I am often skeptical of “libertarianism” because far too often the proponents’ arguments seem no more thoughtful than the childish phrase “you aren’t the boss of me.” As I concluded your interview, I realized that Professor Pilon and you both have made me slightly less stupid today. Thank you. Rich Kopf PS I wonder what Pilon thinks of Judge Posner’s shift, albeit perhaps slight, away from his earlier more doctrinaire adherence to the libertarian law and economics movement.
